Welcome to LensWizard. These Terms & Conditions (“Terms”) govern your use of the LensWizard platform, website, and services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms.
Please read these Terms carefully before using the Service.
1. Service Description
1.1 Platform Overview
LensWizard is an online marketplace that connects professional photographers (“Photographers”) with customers (“Customers”) seeking photography services. The platform facilitates booking, payment processing, and photo delivery.
1.2 Role of the Platform
LensWizard acts as an intermediary and payment processor. LensWizard is not a party to the agreement between Photographers and Customers. The contractual relationship for photography services is directly between the Photographer and the Customer.
1.3 Services Provided
- Booking management and scheduling
- Secure payment processing via Stripe
- Photo storage and delivery
- Communication tools between Photographers and Customers
- Marketing tools for Photographers
2. Account Terms
2.1 Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete registration information
- Maintain the security of your account credentials
2.2 Account Types
Customer Accounts: Allow you to browse photographers, book photo sessions, and receive photos.
Photographer Accounts: Allow you to list photography services, manage bookings, receive payments, and deliver photos. Photographers must complete identity verification through our payment processor (Stripe) before receiving payouts.
2.3 Account Responsibilities
You are responsible for:
- All activity that occurs under your account
- Maintaining accurate and up-to-date account information
- Keeping your password confidential
- Notifying us immediately of any unauthorized access
2.4 Account Suspension and Termination
We may suspend or terminate accounts that:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Receive repeated complaints from other users
- Remain inactive for extended periods
- Fail to complete required identity verification
3. Booking and Payment Terms
3.1 Booking Process
When a Customer books a photography session:
- The Customer selects a time slot and provides required information
- Payment is processed immediately through Stripe
- Both parties receive confirmation of the booking
- The Photographer provides the agreed-upon services
- Photos are delivered through the platform
3.2 Pricing
- Photographers set their own prices for services
- All prices are displayed inclusive of applicable fees
- Early bird pricing, when offered, is valid until the specified deadline
- Currency is displayed as set by the Photographer (default: EUR)
3.3 Platform Fee
LensWizard charges a service fee on each booking, which is automatically deducted from the total payment before transfer to the Photographer. The current service fee is 10%.
3.4 Payment Processing Fees
In addition to the platform fee, standard payment processing fees apply. These fees are charged by our payment processor (Stripe) and typically include:
- Card transactions: Approximately 1.5% + €0.25 for European cards, or 2.9% + €0.25 for non-European cards
- These fees are deducted from the Photographer’s payout
Payment processing fees may vary based on card type, country of origin, and other factors. See Stripe’s pricing for current rates.
3.5 Payment Processing
- Payments are processed securely through Stripe
- By using our Service, you agree to Stripe’s Terms of Service
- Funds are transferred to Photographers according to their payout schedule (typically weekly)
- Minimum payout threshold: €20
3.6 Tax Responsibility
Photographers are responsible for:
- Reporting and paying all applicable taxes on their earnings
- Maintaining proper business registrations as required by law
- Issuing invoices to Customers where required
LensWizard will provide tax documentation as required by law (e.g., 1099-K forms for US-based Photographers).
4. Cancellation and Refund Policy
4.1 Customer Cancellations
The following refund policy applies when a Customer cancels a booking:

| 24–48 hours | 50% refund |
| Less than 24 hours | No refund |
Refund requests must be submitted through the platform. Processing may take 5–10 business days.
4.2 Photographer Cancellations
If a Photographer cancels a confirmed booking:
- The Customer receives a full refund (100%)
- Repeated cancellations may result in account penalties or suspension
4.3 No-Show Policy
- Customer no-show: No refund is provided
- Photographer no-show: Full refund plus potential account penalties
4.4 Force Majeure
In cases of documented emergency, natural disaster, or other circumstances beyond reasonable control, alternative arrangements may be considered at our discretion.
4.5 Disputes
For booking disputes not covered above, contact us at support@lenswizards.com. We will review each case individually and make a determination within 10 business days.
5. Photo Delivery and Access
5.1 Delivery Method
Photos are delivered through secure gallery links accessible via the Customer’s account. Customers receive an email notification when photos are ready.
5.2 Access Duration
Gallery access is provided for a reasonable period following delivery. We recommend downloading photos promptly as extended storage is not guaranteed indefinitely.
5.3 Photo Quality
LensWizard does not guarantee the quality, style, or content of photos. The photography agreement is between the Customer and Photographer. Customers should review Photographer portfolios before booking.
6. Intellectual Property
6.1 Photo Ownership
Photographers retain full copyright ownership of all photos they create. By booking a session, Customers receive a limited license to use photos as described below.
6.2 Customer License
Upon payment, Customers receive a non-exclusive, non-transferable license to use photos for:
- Personal, non-commercial purposes
- Social media posting (with credit where requested)
- Personal printing and display
Prohibited uses include:
- Commercial use without separate agreement
- Resale or redistribution
- Use in advertising or promotional materials without permission
- Modification or derivative works without permission
6.3 Platform License
Photographers grant LensWizard a limited license to:
- Display portfolio images on the platform
- Use images for platform marketing (only with explicit consent)
- Store and transmit images for delivery purposes
6.4 Model Releases
Photographers are responsible for obtaining any required model releases or permissions from subjects. LensWizard is not responsible for photos taken without proper consent.
7. Acceptable Use
7.1 Prohibited Conduct
Users must not:
- Provide false or misleading information
- Engage in fraudulent bookings or payments
- Harass, abuse, or threaten other users
- Upload illegal, harmful, or offensive content
- Attempt to circumvent platform fees (off-platform payments)
- Violate intellectual property rights
- Use automated tools to access the Service
- Impersonate other users or entities
7.2 Content Standards
All content uploaded to the platform must:
- Not contain illegal material
- Not depict minors in inappropriate contexts
- Not contain hate speech or discriminatory content
- Comply with applicable laws
7.3 Enforcement
Violations may result in:
- Content removal
- Account suspension or termination
- Withholding of pending payments
- Legal action where appropriate
8. Limitation of Liability
8.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 Platform Limitations
LensWizard is not liable for:
- Photographer no-shows, cancellations, or delays
- Quality, content, or style of photos
- Disputes between Photographers and Customers
- Third-party service interruptions (Stripe, payment networks, etc.)
- Loss of data or service interruptions
- Actions or conduct of any user
- Weather conditions affecting outdoor sessions
8.3 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF:
- The fees you paid to LensWizard in the 12 months prior to the claim, or
- €100
8.4 Exclusion of Damages
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
8.5 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless LensWizard, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or transmit
- Your interactions with other users
10. Dispute Resolution
10.1 Informal Resolution
Before initiating formal proceedings, please contact us at legal@lenswizards.com. We will attempt to resolve disputes informally within 30 days.
10.2 Governing Law
These Terms are governed by the laws of Germany, without regard to conflict of law principles.
10.3 Jurisdiction
For EU residents, disputes may be resolved through the courts of your country of residence or through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
For non-EU residents, exclusive jurisdiction lies with the courts of Berlin, Germany.
10.4 Class Action Waiver
To the extent permitted by law, you agree to resolve disputes individually and waive any right to participate in class action lawsuits.
11. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.
By using the Service, you consent to:
- Collection of data as described in our Privacy Policy
- Sharing necessary booking information between Photographers and Customers
- Receiving transactional emails related to your bookings
- Receiving marketing communications (with opt-out available)
12. EU Consumer Rights
12.1 Right of Withdrawal
Under EU consumer law, consumers typically have a 14-day right of withdrawal for online purchases. However, this right does not apply to services with a specific date (such as photography sessions) once the service has begun or when the consumer has expressly consented to the service starting before the withdrawal period ends and acknowledged that they will lose their withdrawal right.
By booking a photography session, you acknowledge that:
- The service is scheduled for a specific date
- You consent to the service beginning before the 14-day withdrawal period ends
- You understand that this consent means you cannot exercise the right of withdrawal once the booking is confirmed
12.2 Consumer Guarantee
Nothing in these Terms affects your statutory rights as a consumer under EU law.
13. Modifications to Terms
13.1 Changes
We may modify these Terms at any time. Material changes will be communicated via:
- Email notification to registered users
- Prominent notice on our website
- Updated version number and effective date
13.2 Acceptance
Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using the Service.
13.3 Version History
Previous versions of these Terms are available upon request.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and LensWizard regarding the Service.
14.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
14.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign your rights under these Terms. LensWizard may assign its rights to any successor entity.
14.5 Language
These Terms are available in English and German. In case of conflict, the English version prevails.
